Uruguay y Argentina volvieron a tensar su relación por un conflicto con el funcionamiento de la fábrica de celulosa UPM y no se descarta que el tema pueda culminar en un nuevo litigio internacional entre ambos países.

El hecho de que una empresa finlandesa pida ampliar su producción de 1,1 a 1,3 millones de toneladas de celulosa ha generado un nuevo episodio de tensión entre Uruguay y Argentina. No en vano, el país del sur incrementaría en 140 millones de dólares sus exportaciones. El problema es que el estatuto del Río Uruguay determina que para realizar un cambio en el tope de producción que tiene la empresa sobre el río que limita entre Uruguay y Argentina el gobierno uruguayo debe consultar al argentino, quien tiene un plazo de 30 días para dar una respuesta.

Uruguay realizó las consultas en el marco de la Comisión Administradora del Río Uruguay, pero Argentina pidió información adicional y vencidos los plazos no respondió, expresándose públicamente en contra del aumento a través de su embajador en Montevideo, Dante Dovena.

“La empresa tenía autorizada a producir una cantidad de un millón de toneladas al año, que el fallo de La Haya ha establecido. Tendrá que cumplir eso. Si la empresa le cambia la producción, las condiciones de trabajo, es otra cuestión. Lo que no se puede hacer es estar predispuestos a resolver las cuestiones entre los dos países por la decisión de una empresa privada”, afirmó el embajador el jueves pasado.

Esa misma noche el presidente José Muijca se reunió con él en un bar de la capital uruguaya para transmitirle las posibles soluciones que estaba manejando, pero los detalles de la conversación no trascendieron a la prensa. La decisión del presidente Mujica se conocerá en los próximos días. Uno de los trascendidos más fuertes es que habilite solo una parte del aumento pedido por la empresa finlandesa, accediendo a un tope de 1,2 millones de dólares.

Hasta el momento ni la cancillería argentina, ni la uruguaya, se han expresado formalmente sobre este asunto. En 2006 comenzaron los cortes de ruta por parte de vecinos de la ciudad argentina de Gualeguaychú, que bloquearon la frontera en oposición a la construcción de la fábrica.

A nivel de gobierno, el litigio fue llevado a la  Corte Internacional de Justicia en mayo de 2006, por considerar que el funcionamiento de la planta de celulosa afectaría la sustentabilidad ambiental de la zona y no se habían realizado los procesos adecuados previos a la inicio de las obras, establecidos en el tratado del Río Uruguay.

En febrero de 2010 la Corte Interamericana determinó que si bien Uruguay no había cumplido con sus obligaciones de consulta establecidas en el Tratado del Río Uruguay, Argentina no había podido demostrar que la contaminación del Río fuera causada por el funcionamiento de la empresa y encomendó a ambos países a realizar un monitoreo conjunto de la calidad ambiental de la zona fronteriza.
